The online store Uisuki.com (hereinafter "UISUKI") is operated by the company The Japanese Spirit Company, SAS with a capital of 16,325 euros, whose registered office is at 38 rue des Croissants 92380 Garches, registered in the Nanterre Trade and companies Register under number 794 781 302, represented by Frederick Francqueville in his capacity as President.
These general conditions of sale govern all sales of products presented on the site UISUKI. Any order implies full acceptance without reservation of these general conditions of sale are intended to define the rights and obligations of parties under the online sale of goods offered by UISUKI.
The terms and conditions are subject to change at any time, without notice, the client is asked to read them carefully before each command and the user at each visit.
The products offered by UISUKI are exclusively for adults.
The products offered by UISUKI are those listed in the catalog published on the website www.uisuki.com. These items are offered subject to availability. Each article is accompanied by a description provided by UISUKI from information provided by its suppliers. The photographs in the catalog are as accurate as possible but can not ensure a perfect similarity with the proposed article, particularly with regard to color.
The customer places an order on the website www.uisuki.com. To buy one or more articles, you must follow this order process:

- Choice of payment method
- Confirmation of payment
The order is only closes when the customer has successively completed the steps above and the payment is accepted. UISUKI undertakes, within the limits of available stocks to fulfill orders received on the website. 5. PAYMENT TERMS
The settlement of purchases is made via one of the following means to the client's convenience:

Ordered items will then be reserved by transfer 5 days calendar as of the date command beyond. Passéce time and failing receipt of such transfer, UISUKI reserves the right to cancel the customer's order.
6. TERMS SHIPPING AND DELIVERY
Any order placed on UISUKI 12 pm Monday to Friday (excluding public holidays) will be prepared and shipped the same day, subject to confirmation of payment and availability of the product (s) ordered. Orders placed after 12 am will be processed the next day, unless the order is placed the day before weekend (treatment Monday) or a holiday.
Customer may follow the execution of his order without further cost than the normal cost of communication by email addressed to UISUKI or directly from their personal pages.
An email confirmation of shipment of the order is sent to the purchaser on the day of the actual shipment of the order.
For information, it should be noted that the delivery time (from the effective date of the shipment of the order) for delivery addresses in France depends on the chosen mode of transport: in 24h via Chronopost 48h via Colissimo. Compliance with these delivery sole responsibility of the carrier.
For modes via Colissimo and Chronopost, a tracking number of the status of delivery is sent by email in the wake of the shipping confirmation. The client, called off command can also access the status of their order from their account on UISUKI. Unless otherwise stated prior to the conclusion of the contract, UISUKI undertakes to deliver any ordered product on the site within a maximum period of 30 (thirty) days.
Except in cases of force majeure, if delivery is not made within that period, the customer may request the cancellation of the sale in accordance with Articles L. 114-1 and L. 121-20-3 paragraphs 2 and 3 of the Code of consumption.
The transfer of risk to the customer is effective upon delivery and UISUKI can not be held responsible for any disputes arising after the delivery of the order, once the customer becomes responsible for the products.
The customer has to check the condition of the items delivered. Any anomaly (missing item, damaged package, broken product ...) must necessarily be indicated within 3 business days of receipt. Note that UISUKI can not be held responsible for damage (penetration, impact, tear ...), resulting from transportation, on cases and bottles of cardboard packaging (boxes and therefore outside wood packaging), because of the fragile nature of these elements.
UISUKI and its carrier partner support transport risks and pay the customer provided that the package is returned to the carrier with a letter of complaint substantiated, a copy should be addressed to UISUKI.
Shipping fees vary depending on the weight of the order, the type of carrier selected and place of delivery. Colissimo delivery charges are offered from 140 € purchase tax for shipping addresses located in Metropolitan France only and up to 8kg.
For deliveries outside mainland France, the buyer is deemed to be the importer of the products concerned.
For deliveries outside of the EU or overseas territories, local taxes, local taxes, customs duties or any other chargeable services may be required. They are the sole responsibility of the purchaser and under its full responsibility. 7. GIFT CARDS
Gift cards sold by UISUKI are valid exclusively on www.uisuki.com online store and UISUKI alone is authorized to sell these gift cards.
Gift cards can be set to any component of the basket, whether products, services or delivery costs in the amount associated with the gift card.
If the value of the order exceeds the amount of the gift card used, the customer must pay the difference through means of payment offered by UISUKI. Conversely, if the amount of the gift card is greater than the total of the command to which it is applied, a credit of the amount of the difference will be generated and emailed to the customer who will then be able to use it during ' next order. This credit may in no case be substituted with a cash refund for the same amount.
The expiration time of UISUKI gift cards is a year from the date of purchase. This expiration period also applies to assets generated through the use of UISUKI gift card.
UISUKI gift card has no money value, it can not under any circumstances be exchanged against an equivalent amount in cash.
Gift cards are exclusively offered by UISUKI dematerialized and are transmitted to the client or beneficiary through a PDF file or email depending on the mode selected at purchase time of order. The gift card is not a physical object and therefore has no associated shipping costs (delivery charges nevertheless apply when ordering also including products other than the gift card).
8. RIGHT TO RETRACT
This clause is applicable only when entering Distance Selling in the scope of Article L. 121-21 of the Code of French consumption, that is to say in the event of sale of property UISUKI concluded between a consumer and which, without the simultaneous physical presence of the parties who use, for the conclusion of this contract, exclusively one or more distance communication techniques.
Each customer has a period of fourteen (14) days from the receipt of his order to exercise its right of withdrawal without having to justify reasons nor to pay penalties, only remain to the customer charges of returning the goods.
The withdrawal period shall run from the date of receipt of the product and to the shipping date indicated on the return package. The return of the product will be exchanged or, if not possible, a credit equivalent to the amount of the ordered products, credited to the client's user account and argued only UISUKI. In any event, the right of withdrawal, if exercised properly, allows the customer to obtain a refund of his order within a maximum of thirty days.
Given the nature of the products offered, may not be returned as the products are strictly honest, unopened, in their original packaging complete and within fourteen (14) days of receipt of the order.

10. LEGAL WARRANTY
The customer benefits, France, the legal guarantee in accordance with Articles 1641 to 1649 of the Civil Code and L. 211-4 and following of the Consumer Code.
As such, keeping UISUKI remains lack of conformity with the contract and latent defects and lack of conformity in accordance with the provisions thereof. In case of lack of conformity, the customer chooses between repair and replacement.

11. RULES GOVERNING THE GENERAL CONDITIONS
11.1. Applicable law, disputes and challenges
The general conditions are governed by French law and applied and interpreted in accordance with the law. If any of the stipulations of the general conditions is zero, the relevant provision will not be applied but the other stipulations of the general conditions remain in force.
11.4. Computation of time
Deadlines are calculated under Articles 640-642 of the French Code of Civil Procedure.
